CEDAW Convention and Reservations Based on Islamic Law: A Jurisprudential and Legal Reading of the Qatari Experience

This study examines the relationship between the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW) and Islamic law through a comparative legal and jurisprudential framework, with particular focus on reservations entered by Arab and Muslim states and a case study of Qatar. The research analyzes areas of convergence and divergence between the international framework of gender equality and Islamic legal principles, assessing how reservations affect the practical implementation of the Convention in matters related to family law, nationality, and legal procedures. Using an analytical comparative methodology grounded in international legal texts, Islamic jurisprudence, and human rights reports, alongside comparative insights from Turkey and Indonesia, the study finds that the perceived conflict between CEDAW and Islamic law is not absolute but rooted in differing legal philosophies. Several principles advocated by CEDAW — including maternity protection and women’s social empowerment — are consistent with the objectives of Islamic law. The study proposes a maqasid-based interpretation of CEDAW that allows gradual legislative development while preserving cultural and religious identity. It concludes that reservations, while safeguarding legislative sovereignty, may limit the transformative impact of the Convention, highlighting the need for ongoing legal dialogue and jurisprudential engagement.
